Governing Commercial Subscription to the akcount.in Cloud Accounting Platform
1. Acceptance & Parties
These Terms of Service represent a legally binding agreement between the Subscriber entity and M/s SS Enterprise (GSTIN: 10CZUPA0656B1ZX), Patna, Bihar. By activating an account, you confirm statutory authority to bind your organization.
2. Cloud Service Level Agreement (SLA)
Akcount commits to a 99.95% monthly uptime availability SLA for transactional invoicing, E-Way Bill generation, and GST portal filings, excluding pre-announced statutory maintenance windows.
3. Data Ownership & Unconditional Portability
The Subscriber retains exclusive, 100% intellectual property ownership of all customer data, ledger entries, and transaction history. Akcount guarantees full raw export (Excel, CSV, and XML) without hostage retention fees upon request.
4. MCA Rule 3(1) Edit Log Guarantee
Akcount provides continuous, tamper-proof operational edit logging in compliance with the Companies (Accounts) Rules 2014, ensuring that no audit log can be disabled, bypassed, or overwritten.
5. Exclusive Legal Jurisdiction
Any dispute, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts situated in Patna, Bihar, India.
